The child custody myth

You still hear the word custody on television, you still hear people talking about custody and I have clients who will say to me “I want to apply for custody of my children”. There is actually no such thing as custody anymore. The Court have, for want of a better phrase, done away with labelling when it comes to children. So what used to be custody and access which then became residence and contact, those labels have now gone. The Court can make what is known as a child arrangements order and under a child arrangements order the Court can basically say where a child will live on a day to day basis, and what time they will spend time with each parent. The Court have done this to be fair to both parents and they have done away with the labelling when it comes to children and they can make a child arrangements order.
