Adultery as grounds for divorce

Adultery is just one of the grounds for divorce, in this video divorce lawyer Sue Harwood explains the pros and cons of using adultery when applying for a divorce.

If a client discovers that their partner has been having an affair for many years for example, clearly it is a ground for divorce but I think the client needs to understand that that is a reason for presenting a petition for divorce, it is a separate issue in relation to how we settle the arrangements for the children or we settle the finances.

So, it doesn’t necessarily matter whether the spouse has been having an affair for the last ten years or if it is a recent new relationship, the fact is there is no fault or blame attached to divorce these days. Yes it is a reason to bring about the dissolution of the marriage but the Court do not punish a party from the assets of the marriage because of how it broke down.
