The old ideas or labels of child custody and access no longer exist. If what you’re looking for is a formal or legal arrangement in respect of your children then what you are actually looking for today is a child arrangements order. A child arrangements order isn’t automatically granted upon divorce and in fact it is not needed if you can agree arrangements in respect of your children whether that’s living arrangements or how frequently or when you see them. If you can’t agree then it may be necessary to apply for a child arrangements order.
If you feel that a child arrangements order is something that you need, I would advise that you consider a couple of other options. It may be possible to still try and reach a compromise there’s also mediation that should be attempted. Going to Court really should be a last resort.
