The 5 facts you can use as grounds for divorce

Grounds for divorce

When you want a divorce you have to demonstrate one of five facts. The first one is unreasonable behaviour and I always ask my clients to give me four or five reasons why the marriage has broken down. The second one is adultery basically this is a sexual relationship between a man and a woman. The third one is you have been separated for a continuous period of two years and you both agree to a divorce. The fourth one rarely used these days is that you have been deserted for over two years. The fifth and final one is that you have been separated for five years and then you don’t need the agreement of your spouse. The other thing that you need to consider is that you have to be married for twelve months before you can even bring divorce proceedings.

With all divorces we always send a copy of the draft paperwork to your spouse for agreement before matters proceed with a view to things going smoothly and as amicably as possible. If you are wondering on which fact to bring a divorce, give me a call and we can talk through the best solution for you.
