In recent years there’s been a big increase in foreign nationals choosing to divorce in England, rather than their native country. Divorce and family law solicitor Judith Buckland offers some explanation as to why this might be happening.
England is sometimes called the divorce capital of the world simply because England’s divorce jurisdiction can be deemed to be quite generous I suppose in some ways. I think it’s more accurate to say that the Court in England has a very great deal of discretion with regard to orders that they can make and its certainly greater than the discretion in many other jurisdictions. But I think that quite a lot of foreign nationals and certainly ex pats would prefer to use England if at all possible because of that discretion.
