Prenuptials, Paul McCartney and the UK


What has a prenuptial agreement got to do with Paul McCartney?

Well, I bet he wished he had one when he got into his major divorce settlement case with Heather Mills. She didn't end up doing all that well but he had a very unpleasant time of things.  In the last few days a case, discussed here says we are at the point when the Courts will always follow a prenup unless there is a good reason not to do so.

The Press has been looking at this in different ways.

The Times takes the view this is "Judge made law" and we are "getting into step with the rest of Europe"

The Mail thinks this heralds the start of "American style prenups".

The Express is says the woman involved is “delighted” the judges upheld the contract designed to scare off “gold-diggers”.

My view? We can agree to marry and divorce so why not be able to agree on how a divorce should be sorted out?

But the prenup has to be very carefully drawn up to be seen as valid by the Courts. Future events (children are a prime example) need to be included within it and it will need regular change to accord with changing lifestyles.

I see that Peter Andre also signed a Pre Nup and Katie Price has instructed Fiona Shakleton as her lawyer, the same lawyer who represented Paul McCartney and Prince Andrew amongst many of her high profile clients!  They carry more and more weight these days as was recently heard in the case of Radmacher v Granatino….
